Michelle Lodzinski News
Gerald Krovatin testified in front of 17 jurors on March 16, 2016, that his client Michelle Lodzinski did not “purposely and knowingly” contribute to the 1991 passing of her first-born son, Timothy Wiltsey.
Lodzinski, according to Krovatin, was not the monster that had been represented. She was a nice mother who adored her child, and she had never confessed to killing the boy to anybody, including family, friends, the police, or the FBI.
He claimed there was no evidence linking Lodzinski or her son to the blanket that had been discovered in 1992, next to the boy’s bones, in Raritan Centre, Edison. No eyewitnesses, no cause of death, and no history of abuse, he claimed.
If the dots don’t lead anywhere, you can’t join them, according to Krovatin. “In this case, it is impossible for the state to establish murder.”
Three months later, the jury found Lodzinski, a former South Amboy single mother, guilty of her son’s murder. This was one of the most well-known and protracted unresolved cases in Middlesex County. Lodzinski received a 30-year state jail term in January 2017.
Nevertheless, Krovatin persisted in advocating for Lodzinski, and on Tuesday the New Jersey Supreme Court overturned her conviction after concluding that there was no direct or indirect evidence presented at trial indicating Lodzinski had intentionally or willfully caused the death of her son.
After being freed from the Edna Mahan Correctional Facility for Women in Hunterdon County a few hours later, Lodzinski, 54, gave a brief speech to thank everyone who had supported her and worked to get her back to her loved ones. She has two additional sons, and she intends to go back to Florida.
A partner at Fox Rothschild with offices in Morristown and New York and co-chair of the firm’s White Collar Criminal Defence and Regulatory Compliance Practise Group, attorney Matthew S. Adams said the Supreme Court’s decision on Tuesday is significant and represents a rare use of its power to overturn a jury conviction.
